    Maintaining Maritime Traffic Order

    Provisions of the Republic of China on maritime navigation management and security mechanism are seen respectively in Commercial Port of Law and The Law of Ships. In order to comply with international requirements on navigational safety management, the Ministry of Transportation and Communications is currently drafting the “Marine Traffic Safety Act” for enhancing marine traffic safety management and reducing occurrence of marine accidents.

    Coast Guard Administration is commissioned to control and maintain marine traffic order. For fishery disputes and minor vessel collisions, it collects evidence firstly, and then helps civil case parties settle the disputes through mutual agreement and turn criminal cases to judicial agencies for investigation. Those cases that involve parties from both sides of Taiwan Straits are transferred to authority agencies such as Mainland Affairs Council, Straits Exchange Foundation and Council of Agriculture for handling. Focus on enforcing cases of overloaded vessels, “Project for Execution of Control and Maintenance on Ocean Traffic Order” is being formulated for maintaining marine navigation order and protect the safety of lives and properties.
